Payments
3.1 Payment Gateway: All payments processed through our online portal are facilitated by Payfast, a leading payment gateway. By proceeding with a purchase, you acknowledge and agree to abide by all terms, conditions, and restrictions imposed by Payfast. Work of Art Advertising is not responsible for any issues arising directly from the Payfast service, although we will endeavor to assist where possible.
3.2 Merchant Outlet Country & Transaction Currency: Our Merchant Outlet Country is South Africa. The transaction currency for all purchases is the South African Rand (ZAR). All prices displayed on the Portal are in ZAR and will be processed at the rate of exchange at the time the transaction is processed by Payfast.
3.3 Payment Requirement for Work Release: No work will be released or delivered until full payment has been received and cleared by Payfast. This applies to all products purchased through the Portal.
No Refunds Policy
All sales made through the Work of Art Advertising online portal are final. We do not offer refunds or exchanges for any products purchased. By completing your purchase, you acknowledge and agree to this no-refund policy. Please ensure you carefully review your order before confirming payment.
Delivery of Products
5.1 Electronic Submission Only: Please note that Work of Art Advertising provides no physical delivery of any products purchased through this Portal. All completed marketing products will be delivered exclusively via electronic submission through the online portal. You will be notified via email when your purchased product is available for download or access within your client account on the Portal.
5.2 Client Responsibility: It is your responsibility to ensure you have adequate internet access and the necessary software to receive and utilize the electronically delivered products.
Intellectual Property
Upon successful payment and delivery, you will receive usage rights to the purchased marketing product as specified in the individual product description. Work of Art Advertising retains all intellectual property rights to the underlying designs, concepts, and original works, unless otherwise explicitly stated in writing.
Limitation of Liability
Work of Art Advertising will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the portal; (b) any conduct or content of any third party on the portal; or (c) unauthorized access, use, or alteration of your transmissions or content.
Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or related to these Terms or your use of the Portal shall be subject to the exclusive jurisdiction of the courts located in South Africa.
Changes to Terms
