General Terms and Conditions of Sale – SmartContainer
1. Purpose
These General Terms and Conditions of Sale (GTC) define the rights and obligations between SmartContainer (the seller) and any individual or legal entity (the customer) in connection with the sale of custom-made containers, saunas, and modular buildings.
2. Products
The products offered are manufactured, fitted out, or prepared to order according to the specifications agreed upon with the customer.
3. Order
All orders are considered firm and final after:
- written confirmation (email, message, or signed invoice)
- acceptance of these GTC
Once production has begun, no cancellations or modifications will be accepted.
4. Prices
Prices are quoted in euros (€).
They may or may not include delivery charges, which will be specified before confirmation.
The total amount is communicated to the customer before order confirmation.
5. Payment Methods
Payment is made exclusively by bank transfer.
For all custom orders:
- Advance payment (50% deposit or full payment) is required after the invoice is issued.
- 100% payment upon delivery is not accepted.
The order is confirmed only after receipt of payment.
This condition is justified by the upfront costs incurred (manufacturing, materials, transport).
6. Manufacturing and Delivery Times
Delivery times are provided for informational purposes only.
SmartContainer cannot be held liable for delays due to:
- Carriers
- Suppliers
- Force majeure
7. Delivery
Delivery is made to the address provided by the customer.
The customer must check the condition of the product upon receipt.
Any anomaly must be reported within 3 days of receipt.
8. Claims
All claims must be made in writing (email or message) within a reasonable time after receipt.
9. Right of Withdrawal
In accordance with European regulations, the right of withdrawal does not apply to custom-made or personalized products.
10. Liability
The seller shall not be held liable for:
- misuse of the product
- improper installation
- or modifications made by the customer
11. Warranties
The products are covered by the applicable legal warranties in accordance with current legislation.
12. Acceptance
Order confirmation implies full and unreserved acceptance of these Terms and Conditions.
