Terms and Conditions for Muncho

Welcome to Muncho, South Africa's first student grocery service. These Terms and Conditions ("Terms") govern your access to and use of Muncho's website, mobile application, services, events and giveaways. By registering an account, placing an order, or otherwise using our services, you agree to be bound by these Terms and by our Privacy Policy, which forms part of these Terms. Please read them carefully. If you do not agree, you may not use our services.

1. Who We Are and How to Contact Us
Muncho's services are provided by:

Muncho (Pty) Ltd (Registration No. K2024178461), the operating company through which all Services are fulfilled, including the processing of orders, payments and deliveries and the fulfilment of student welfare programmes, events and giveaways; and

Muncho Foundation NPC (Registration No. K2025045018), a non-profit company registered as a Nonprofit Organisation with the Department of Social Development (NPO Registration No. 318-776 NPO), under whose direction student welfare programmes, events and giveaways are conducted, with fulfilment and delivery of such programmes carried out by Muncho (Pty) Ltd,

together referred to as "Muncho", "we", "us" or "our".

This information is provided in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").


2. Definitions
"Muncho" means Muncho (Pty) Ltd and Muncho Foundation NPC, as identified in clause 1.

"User", "you" or "your" means any person accessing or using Muncho's services.

"Services" means the sale and delivery of groceries and related products, vouchers, events, giveaways and any related activities offered by Muncho.

"Partners" means suppliers, brands, retailers, financial services providers, student residences and buildings, and other entities collaborating with Muncho.

"Partnered Residence" means a student residence or building in which Muncho operates under arrangement with the residence operator or building management.

"Events" means activities for community engagement and student welfare conducted under the direction of the Muncho Foundation and fulfilled by Muncho (Pty) Ltd.

"Muncho Foundation" means Muncho Foundation NPC (Registration No. K2025045018), registered as a Nonprofit Organisation with the Department of Social Development (NPO Registration No. 318-776 NPO).

"Vouchers" means credits or codes issued by Muncho which may be redeemed against products or Services, whether purchased by a User ("Paid Vouchers") or issued free of charge by Muncho for promotional purposes ("Promotional Vouchers").

"CPA" means the Consumer Protection Act 68 of 2008.

"POPIA" means the Protection of Personal Information Act 4 of 2013.

"Business Day" means any day other than a Saturday, Sunday or South African public holiday.


3. Eligibility and Account Registration
Muncho's services are available to students residing in South Africa, primarily within Partnered Residences.

You must be at least 18 years of age to register for or use our services. By registering or placing an order, you confirm that you are at least 18 years old. Persons under 18 may only use the platform with the authorisation of a parent or legal guardian, who accepts these Terms on the minor's behalf and consents to the processing of the minor's personal information as set out in our Privacy Policy.

You must provide valid student identification to access student-specific services and pricing. Muncho reserves the right to verify the authenticity of any identification provided and to decline or revoke access where verification fails.

You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account. Notify us immediately at support@muncho.co.za if you suspect unauthorised use of your account.

You warrant that all information you provide to Muncho is true, accurate, current and complete, and that you will keep it updated.


4. Ordering
Products displayed on our platform constitute an invitation to do business and not a binding offer. An agreement of sale is concluded only when Muncho accepts your order by confirming it (by email, in-app notification or SMS) after successful payment authorisation.

Orders must be placed by 12 PM for same-day processing. Orders placed after the cut-off will be processed on the next delivery cycle.

Muncho may decline or cancel an order, before dispatch, where a product is unavailable, a pricing or description error has occurred, payment cannot be processed or verified, we reasonably suspect fraud or misuse, or the delivery location is not serviceable. If we cancel an order after payment, you will receive a full refund of the amount paid for the cancelled items within 7 Business Days.

Product images are for illustration purposes. While we take care to display products accurately, minor variations in packaging, size or appearance may occur. Where a specific item is unavailable, Muncho may offer a suitable substitute of equal or greater value, which you may decline for a refund of that item.


5. Pricing and Payment
All prices are quoted in South African Rand and include VAT where applicable. Delivery fees, where charged, are displayed before checkout.

While we take reasonable care to ensure pricing accuracy, obvious errors (such as a price that is manifestly incorrect) do not bind Muncho, and we may cancel affected orders and refund you in full.

Payment is processed at checkout through our third-party payment gateway partners. Muncho does not store your full card details. Available payment methods are displayed at checkout.

Muncho reserves the right to change prices, products and delivery fees at any time. Changes do not affect orders already confirmed.


6. Delivery and Collection
Deliveries are made during designated daily time slots to Partnered Residences, scheduled to reduce CO2 emissions and traffic congestion. Delivery slots are estimates and not guaranteed times, though we will take reasonable steps to notify you of material delays.

Unless otherwise stated for your residence, packages are handed to the security or reception desk of your residence for collection. You will be notified when your package is ready. Risk in the products passes to you on handover to you or to the designated collection point at your residence.

You must collect your package within the timeframe communicated in the collection notification. Muncho is not responsible for the deterioration of perishable items where collection is delayed beyond that timeframe through no fault of Muncho.

Muncho may refuse or suspend delivery where an order is incomplete, payment has not been processed, or the delivery location is inaccessible or unsafe.


7. Returns, Refunds and Defective Products
Defective or incorrect items: In accordance with sections 55 and 56 of the CPA, you are entitled to receive products that are of good quality, free of defects and suitable for their intended purpose. If a product is defective, damaged, expired on delivery, or not what you ordered, notify us at support@muncho.co.za within 48 hours of collection (given the perishable nature of groceries) with your order number and, where possible, a photo. We will, at your election and as required by the CPA, replace the item, or refund the price paid for it.

Perishable goods: Due to health and safety considerations, perishable food items cannot be returned or refunded for change of mind. This does not affect your rights in respect of defective or incorrect items.

Non-perishable goods: Unopened, non-perishable items in their original condition may be returned for a refund or exchange within 7 days of collection.

Cooling-off under ECTA: Section 44 of ECTA provides a 7-day cooling-off period for certain goods purchased online. Please note that in terms of section 42(2) of ECTA, this cooling-off right does not apply to foodstuffs, beverages or other goods intended for everyday consumption. Where the cooling-off right applies to a non-food item, you may cancel within 7 days of delivery and receive a refund, less the direct cost of returning the goods.

Refund processing: Approved refunds are processed to your original payment method within 7 Business Days of approval.


8. Vouchers
Paid Vouchers remain valid for 3 years from the date of issue, in accordance with section 63 of the CPA, unless redeemed earlier. Any unredeemed value remains available to you for the full validity period.

Promotional Vouchers are issued free of charge at Muncho's discretion and may carry a shorter expiry date, which will be stated at issue. Promotional Vouchers have no cash value, cannot be exchanged for cash, and expire on the stated date.

Vouchers are personal to the User to whom they are issued unless expressly stated to be transferable. Muncho is not responsible for vouchers that are lost, stolen or used without your authorisation where this results from your failure to keep voucher codes secure.

Packages may be personalised and may include additional complimentary items at Muncho's discretion. Complimentary items are not guaranteed and carry no cash or exchange value.


9. Events, Giveaways and Promotional Competitions
Participation in Events and giveaways is voluntary and subject to the specific rules published for each Event or giveaway. Where these Terms conflict with published competition rules, the competition rules prevail for that competition.

Promotional competitions are conducted in accordance with section 36 of the CPA. No payment or purchase beyond the ordinary price of goods is required to enter unless expressly permitted by law, and winners will be selected and notified as set out in the applicable rules.

Muncho reserves the right to modify, cancel or suspend any Event or giveaway on reasonable notice where required by circumstances beyond our control or low participation, subject to applicable law.

Prizes are non-transferable and cannot be exchanged for cash unless the competition rules state otherwise. Winners may be invited to participate in reasonable promotional activities related to the competition. Participation in such promotional activities is voluntary and subject to the winner's consent, in accordance with section 36(5)(d) of the CPA.


10. Partner Relationships
Muncho collaborates with Partners, including suppliers, brands, retailers, financial services providers, and residence operators, to provide and enhance its Services.

Products supplied through Muncho may be manufactured or supplied by third parties. Nothing in these Terms limits your rights under the CPA, including section 61, in respect of defective products. Where a product issue arises, contact Muncho first at support@muncho.co.za and we will resolve it with you or direct the matter to the responsible supplier where appropriate.

Muncho may feature promotional content, offers, pricing benefits or branded materials from Partners on its platform and within Partnered Residences. Featured Partner content does not constitute an endorsement or guarantee by Muncho of the Partner's products or services, save where Muncho itself supplies the product.

Data sharing with Partners is governed by our Privacy Policy. In summary, Muncho shares aggregated, de-identified insights with Partners, and shares information that identifies you personally only with your express, opt-in consent, which you may withdraw at any time by emailing privacy@muncho.co.za.


11. Marketing and Communications
Muncho will send you transactional and service communications (such as order confirmations, delivery notifications and material changes to these Terms) as part of providing the Services.

Direct marketing by electronic means is conducted in accordance with section 69 of POPIA and applicable consumer protection laws. You may opt out of marketing communications at any time via the unsubscribe mechanism in the communication or by emailing privacy@muncho.co.za. Opting out of marketing does not affect transactional communications or your use of the Services.


12. Privacy and Data Protection
Muncho processes personal information in accordance with POPIA and our Privacy Policy, available at www.muncho.co.za, which forms part of these Terms.

The Privacy Policy sets out what we collect, how we use it, how we share it (including aggregated Partner insights and consent-based sharing), our security safeguards under section 19 of POPIA, our breach notification commitments under section 22 of POPIA, your rights as a data subject, and how to contact our Information Officer, Ahmed Masoud, at privacy@muncho.co.za.

You have the right to access, correct or request deletion of your personal information, and to lodge a complaint with the Information Regulator (South Africa), as detailed in the Privacy Policy.


13. Acceptable Use
You may not, in connection with the Services: provide false, misleading or fraudulent information, including false student identification; use the Services for any unlawful purpose or in breach of any applicable law; resell products purchased through Muncho on a commercial basis without our written consent; interfere with, disrupt or attempt to gain unauthorised access to the platform, other users' accounts or Muncho's systems; scrape, harvest or extract data from the platform by automated means without our written consent; or abuse, harass or threaten Muncho staff, delivery personnel, residence staff or other users.

Muncho may suspend or terminate the account of any User who breaches this clause, in accordance with clause 16.


14. Intellectual Property
All content on the Muncho platform, including the Muncho name, logo, mascot, trade marks, designs, text, graphics, software and data compilations, is owned by or licensed to Muncho and is protected by South African and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify or create derivative works from any platform content without Muncho's prior written consent.

Partner trade marks and branding displayed on the platform or in Partnered Residences remain the property of the respective Partners.


15. Liability
Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited, including liability arising from gross negligence or wilful misconduct, liability under section 61 of the CPA for harm caused by defective goods, or any other right or remedy you have under the CPA, ECTA or other applicable law.

Subject to the above, Muncho is not liable for indirect, consequential or special damages, loss of profits, or loss of data arising from your use of the Services; delays or failures caused by events beyond our reasonable control, including load shedding, network failures, strikes, and acts of residence management restricting access; the acts or omissions of residence security or reception staff after handover of your package to the designated collection point; or the deterioration of perishable items not collected within the communicated timeframe, where the delay is not attributable to Muncho.

Subject to the first paragraph of this clause, Muncho's total aggregate liability to you arising from or in connection with any order is limited to the value of that order.

You indemnify Muncho against claims, damages and expenses arising from your breach of these Terms or your unlawful use of the Services, except to the extent caused by Muncho's own negligence or breach.


16. Suspension, Termination and Cancellation
By you: You may close your account at any time by emailing support@muncho.co.za. Closure does not affect orders already confirmed, which will be completed or refunded in accordance with these Terms. On closure, your personal information will be handled as set out in the Privacy Policy.

By Muncho: We may suspend or terminate your access to the Services where you materially breach these Terms, provide fraudulent identification or payment information, or misuse the Services, and, in the case of a remediable breach, you fail to remedy it within a reasonable period after written notice. In cases of fraud or serious misconduct, suspension or termination may take effect immediately.

If your account is terminated, any undelivered confirmed orders will be refunded, and any unredeemed Paid Voucher value will be refunded or honoured for its remaining validity period, save where the value was obtained fraudulently.

You may appeal a termination decision by emailing support@muncho.co.za within 14 days of termination.


17. Amendments
Muncho may amend these Terms from time to time. Material changes will be notified to you by email, in-app notice or prominent notice on our website at least 7 days before they take effect, save where changes are required by law to take effect sooner.

Amendments do not apply retrospectively to orders already confirmed. Your continued use of the Services after the effective date of notified changes constitutes acceptance of the amended Terms. If you do not accept the amended Terms, you may close your account under clause 16.

The current version of these Terms will always be available at www.muncho.co.za.


18. Disputes, Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa.

If a dispute arises, please contact us first at support@muncho.co.za. We aim to acknowledge complaints within 3 to 5 Business Days and to resolve them promptly and in good faith through informal negotiation.

Nothing in these Terms prevents you from referring a dispute to the National Consumer Commission, the Consumer Goods and Services Ombud, the Information Regulator (for data protection matters), or any other forum available to you under applicable law.

Subject to the above, the parties consent to the jurisdiction of the South African courts.


19. General
These Terms, together with the Privacy Policy and any published competition or event rules, constitute the entire agreement between you and Muncho regarding the Services.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

No failure or delay by Muncho in enforcing any right under these Terms constitutes a waiver of that right.

You may not cede, assign or transfer your rights or obligations under these Terms without Muncho's written consent. Muncho may cede or assign its rights and obligations to a successor in title on notice to you.

In these Terms, references to legislation include that legislation as amended or replaced from time to time.
