Below is the full set of policies that govern every transaction on bikeablekenya.com (the “Site”). By visiting or purchasing from the Site you agree to be bound by the terms below, which are drafted to comply with the Consumer Protection Act, 2012, the Data Protection Act, 2019, the Competition Act, 2010, and guidance issued by the Communications Authority of Kenya for e-commerce operators.

1. Definitions & Scope

“Bikeable Kenya”, “we”, “our”, or “us” means Bikeable Kenya Ltd., registered in the Republic of Kenya. “You” or “Customer” means any natural or legal person transacting on the Site. These policies apply to all goods and services advertised or supplied online, including high-end bicycles, frames, spare parts, accessories, thrifted apparel, cycling shoes and any other merchandise we list.

2. Eligibility & Account Security

You must be at least 18 years old, provide accurate personal data, and maintain the confidentiality of your login credentials. Unauthorised use of another person’s account is prohibited.

3. Ordering & Contract Formation

A contract forms once we email an Order Confirmation. We reserve the right to refuse or cancel an order if stock is unavailable, payment fails, or fraud is suspected. Prices shown include VAT where applicable; any import duties on special-order items are payable by the customer.

4. Payment Methods

We accept:

M-PESA STK Push & Paybill

Visa / MasterCard / American Express

Bank Transfer (KES only)


All payments are processed through PCI-DSS-compliant gateways. We do not store full card numbers.

5. Shipping & Delivery

*Transit times exclude weekends & public holidays. Risk passes to you upon delivery signature or completed M-PESA confirmation for kiosk collection.

6. Returns & Refunds – 7-Day “Cooling-Off”

Under Section 41 of the Consumer Protection Act you may cancel a remote purchase within seven (7) days of receiving the goods.

How to return:

1. Email returns@bikeablekenya.com with order number & reason.


2. Securely re-pack the item in original condition (unridden / unworn, tags attached).


3. Send to the address we provide or drop at our Nairobi service hub.



Return freight is at your cost unless we shipped the wrong or defective item.
Once inspected, we’ll issue a refund (minus outbound shipping) to your original payment method within 7 business days.

Exclusions:

Personal-fit items cut or heat-moulded (e.g. custom insoles)

“Final Sale” or clearance items flagged NO-RETURN in the listing

Used drivetrain and brake components once fitted or greased


7. Warranty on Select Items

• New, manufacturer-sealed goods: full factory warranty (typically 12–24 months).
• Framesets & wheelsets: lifetime or limited period as per brand policy; proof of professional installation required.
• Thrifted / pre-owned items: sold “as-is” with no warranty beyond the 7-day return window.

Warranty claims cover defects in materials or workmanship only; they exclude crash damage, misuse, normal wear, or unauthorised modifications.

8. Data Privacy & Cookies

We process personal data strictly in line with the Data Protection Act 2019 and guidance from the Office of the Data Protection Commissioner. Key points:

Lawful basis – we rely on contract (to fulfil your order) and consent (marketing emails).

Data subjects’ rights – access, rectification, erasure, objection, portability.

Retention – transaction data kept for 7 years to satisfy KRA & CAK record-keeping.

Cookies – functional cookies are essential; analytics cookies load only after opt-in.


You may withdraw consent at any time via “My Account” or by emailing privacy@bikeablekenya.com.

9. Intellectual Property

All text, photography, video, code and logos on the Site are property of Bikeable Kenya or its licensors and may not be reproduced without written permission. Brand names and trademarks belong to their respective owners.

10. Health & Safety Disclaimer

Cycling can be hazardous. Always follow manufacturer torque specs, wear approved helmets, and have critical components installed by a qualified mechanic. We accept no liability for injuries arising from improper assembly or negligent use.

11. Limitation of Liability

To the fullest extent permitted by Kenyan law, our total liability for any claim shall not exceed the price paid for the product giving rise to the claim. We shall not be liable for indirect or consequential losses.

12. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g. strikes, acts of God, government restrictions).

13. Dispute Resolution & Governing Law

These policies are governed by the laws of Kenya. We prefer to settle disputes amicably within 14 days; failing that, either party may lodge a complaint with the Competition Authority of Kenya or refer the matter to arbitration under the Kenyan Arbitration Act.

14. Amendments

We may update these policies at any time. Material changes will be posted on the Site at least 14 days before they take effect. Your continued use after that constitutes acceptance.
