General Terms and Conditions of Sale
These Terms and Conditions of Sale apply to purchases made through www.kanso.mu, by telephone, through social media, or directly from our showroom. These terms and conditions are between you (the Customer) and Kanso (Eutychus Ltd - the Seller).
Please read them carefully before placing an order.
1. Application of these Terms
By placing an order with Kanso, you confirm that:
- You have read and accepted these Terms and Conditions;
- The information supplied by you is accurate and complete;
- You are at least 18 years old and legally capable of entering into a contract; and
- You are authorised to use the selected payment method.
These Terms apply alongside all mandatory rights granted under the laws of Mauritius. Nothing in these Terms excludes or restricts any right or remedy that cannot legally be excluded.
2. Product information
Kanso make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications, colours and prices are accurate.
However:
- Images may be for illustrative purposes;
- Colours may vary depending on lighting, photography and screen settings;
- Natural materials may have variations in colour, grain, texture or finish;
- Measurements may be approximate;
- Product packaging may differ from images displayed.
Customers must check product dimensions, electrical requirements, access routes and installation requirements before ordering.
3. Prices
Unless otherwise stated:
- All prices are displayed in Mauritian Rupees;
- Prices include VAT where legally applicable;
- Delivery, assembly, installation, electrical works, plumbing works, and other additional services are not included unless expressly stated in the order confirmation; and
- Promotional prices apply only during the stated promotional period and while stocks last.
If a product is mistakenly displayed at an incorrect price, Kanso may correct the error before accepting the order. Kanso will inform you and allow you to confirm the order at the correct price or cancel it for a full refund of any amount already paid.
A VAT invoice will be issued where required under Mauritian tax legislation.
4. Orders and acceptance
Submitting an order does not automatically mean that it has been accepted.
An order becomes binding only when:
- Kanso confirm acceptance in writing, electronically or by issuing an invoice or order confirmation; and
- Kanso receive the required payment or deposit.
Kanso may refuse or cancel an order where:
- The product is unavailable;
- The price or description contains an obvious error;
- Payment is not authorised or is suspected to be fraudulent;
- Delivery or installation cannot reasonably be completed at the specified location; or
- Accepting the order would breach applicable law.
If Kanso cancel an order after receiving payment, Kanso will refund the amount paid for the cancelled item or service.
5. Payment
Available payment methods may include cash, bank transfer, Juice, Blink, myt money, or another method approved by Kanso.
Payment terms will be stated on the order confirmation or invoice. Unless otherwise agreed:
- Stock items must be fully paid before delivery or collection;
- Special-order, customised or imported products require the stated deposit;
- Installation may require advance payment before work is scheduled; and
- Ownership of products remains with Kanso until full payment has been received.
The customer must use the invoice or order number as the payment reference. Bank charges and payment-provider fees imposed on the customer are the customer’s responsibility.
6. Deposits and outstanding balances
Deposits secure the customer’s order and allow Kanso to reserve, manufacture or procure products.
Unless the order is cancelled due to Kanso's inability to supply it, a deposit may be non-refundable where it relates to:
- A customised or made-to-order product;
- A product specially imported or ordered for the customer;
- Goods already reserved, manufactured or dispatched by a supplier; or
- Work or expenses already reasonably incurred for the order.
Any outstanding balance must be paid by the agreed due date and, in all cases, before delivery or installation unless credit terms have been approved in writing.
These provisions do not affect any mandatory right the customer may have under Mauritian law.
7. Product availability
All products are subject to availability.
If an ordered product becomes unavailable, Kanso may offer:
- A suitable alternative product;
- A revised delivery date; or
- Cancellation and a refund for the unavailable product.
Kanso will not replace a product with a materially different item without the customer’s agreement.
8. Delivery
Delivery dates and times are estimates unless expressly guaranteed in writing.
The customer must provide:
- A correct and complete delivery address;
- An accessible delivery location;
- A contact person who will be available to receive the goods; and
- Advance notice of stairs, narrow passages, restricted access, parking restrictions or any other obstacle.
Standard delivery does not include lifting products over balconies, dismantling doors, structural work or using special lifting equipment unless expressly agreed.
Kanso are not responsible for delays caused by circumstances reasonably outside our control, including severe weather, road closures, port delays, customs procedures, supplier delays, strikes, accidents or force majeure events.
9. Failed delivery and storage
If delivery cannot be completed because:
- Nobody is available to receive the goods;
- The address or contact details are incorrect;
- Access is unsafe or unsuitable;
- The customer refuses delivery without a legally valid reason; or
- The customer has not paid the outstanding balance,
Kanso may charge reasonable redelivery and storage costs.
If the customer repeatedly fails to accept delivery, Kanso may cancel the order after giving reasonable notice and deduct any lawful and reasonable costs already incurred, without affecting the customer’s statutory rights.
10. Inspection upon delivery or collection
The customer or authorised representative should inspect the goods upon delivery or collection.
Any visible damage, missing item or incorrect product should be:
- Recorded on the delivery note before it is signed; and
- Reported to us as soon as reasonably possible, preferably within 48 hours, with photographs and the invoice number.
Signing a delivery note without recording visible damage may be treated as confirmation that the goods were received in apparent good condition. It does not remove any rights concerning defects that could not reasonably have been identified at delivery.
11. Risk and ownership
Risk of accidental loss or damage passes to the customer when the product is delivered to the customer or collected by the customer or their authorised representative.
Legal ownership remains with Kanso until the full purchase price and any related amounts have been paid.
Until ownership passes, the customer must not resell, pledge or dispose of the goods without Kanso's written consent.
12. Returns and change of mind
Unless Kanso publish a separate returns policy or agree otherwise in writing, Kanso do not automatically accept returns simply because a customer has changed their mind.
Where Kanso agree to a discretionary return:
- The request must be made within 1 day;
- The original invoice must be provided;
- The product must be unused, uninstalled and in resalable condition;
- All packaging, accessories, manuals and promotional items must be returned; and
- Delivery, collection, installation and payment-processing costs may be charged to the customer.
This section does not restrict the customer’s legal remedies where goods are defective, unsafe, misdescribed or otherwise fail to comply with applicable law.
13. Defective, damaged or incorrect products
If a product is defective, damaged, unsafe, incorrectly supplied or materially different from its description, please contact Kanso promptly with:
- The invoice or order number;
-A description of the issue;
- Photographs or video where reasonably possible; and
- The product’s model and serial number, where applicable.
Kanso may inspect or test the product before determining the appropriate remedy.
Depending on the circumstances and applicable law, the remedy may include repair, replacement, completion of missing parts, a price reduction or refund.
14. Warranty
The applicable warranty period and conditions will appear on the invoice, or warranty card.
Unless otherwise stated, a warranty does not cover damage caused by:
- Incorrect installation or installation by an unauthorised person;
- Misuse, negligence, abuse or failure to follow instructions;
- Unauthorised repairs or modifications;
- Incorrect voltage, electrical surges or defective wiring;
- Water damage, excessive moisture, corrosion or pest infestation;
- Normal wear and tear or consumable parts;
- Accidental or cosmetic damage after delivery;
- Failure to carry out required maintenance;
- Use of unsuitable chemicals or cleaning products; or
- Events outside reasonable control, including lightning, flooding, fire and natural disasters.
15. Solar and technical installations
For solar lights and other technical systems:
- System performance estimates depend on weather, shading, orientation, roof conditions, energy use, equipment settings and grid conditions;
- Estimated generation or savings are projections and not guaranteed results;
16. Promotions and discount codes
Promotions are subject to their advertised terms, validity dates and stock availability.
Unless expressly permitted:
- Promotional offers cannot be combined;
- Discount codes have no cash value;
- Discounts cannot be applied retrospectively; and
- Free gifts cannot be exchanged for cash.
If an order qualifying for a free gift is cancelled or returned, the gift must also be returned unused, failing which its advertised value may be deducted from any refund where lawful.
17. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, gross negligence, death or personal injury caused by negligence, or mandatory consumer remedies.
Subject to applicable law, Kanso is not responsible for:
- Indirect or consequential losses not reasonably foreseeable when the order was accepted;
- Losses arising from incorrect information supplied by the customer;
- Damage caused by unauthorised installation, alteration or misuse;
- Incompatibility that the customer was responsible for checking; or
- Delay caused by events outside our reasonable control.
For business customers, and only to the extent permitted by law, our aggregate liability relating to an order will not exceed the amount paid for the affected product or service.
18. Changes to these Terms
Kanso may update these Terms from time to time to reflect changes to our business practices or applicable law.
The version applying to an order is the version published or provided to the customer when the order is placed, unless a change is required by law.
