1. Menu Offerings
1.1 The menu items ("Food") provided by Bagelstreet ("we," "us," or "our") for delivery and/or collection are listed on this website ("Site") or online application ("App"). These offerings are subject to updates and modifications at our discretion.
1.2 Photographs displayed on the Site/App are for illustrative purposes only. Actual food items may differ in appearance. Additionally, there may be limitations on the quantity of food items available for order; any such restrictions will be indicated on the Site/App.
1.3 All food items are offered as described in their respective headers and descriptions without variation. Photographs depicting menu items alongside sides, snacks, beverages, etc., are for illustration only; such additional items are not included in the price unless explicitly stated. We are not obligated to fulfill requests based solely on illustrative content.
1.4 All and every ingredient used in the processing of your food is Halaal certified by its manufacturer and further audited and certified by the South African National Halaal Authority (SANHA) under certification number S-1660
2. YOUR INFORMATION
2.1 We collect only the information necessary to provide our services to you. We do not share your information with third parties. By agreeing to these terms, you consent to receive communications from us via SMS, email, and/or WhatsApp regarding orders, inquiries, marketing, promotions, or other lawful purposes.
PRICING
3.1 Prices for our food items are displayed on the Site/App and are subject to change at anytime based on type, quantity, size, and any requested variations or upgrades.
3.2 Orders placed outside our standard operating hours (before opening or after closing times) may incur additional charges.
RECIPES & INGREDIENTS
4.1 Our recipes are proprietary creations made with premium-grade ingredients. We do not replicate or imitate menu items from other businesses; each item is conceptualized by our owner and founder. We collaborate with trusted suppliers to maintain consistency and quality.
4.2 In the event of ingredient shortages, we reserve the right to substitute an ingredient, provided such substitution results in less than a 10% change to the recipe.
4.3 Supplier price adjustments throughout the year may impact our pricing. Consequently, we may increase the prices of individual items or categories without prior notice. However, we commit to maintaining our serving sizes and will not reduce portions to offset profit losses.
FOOD DELIVERY SERVICE
5.1 Delivery is available within a 6 km radius from our location in Kelvin and is charged at rates consistent with industry standards.
5.2 If delivery is unavailable, this will be indicated on the Site/App or communicated via WhatsApp, SMS, or telephone. When delivery is available, it may be limited to specific times or areas.
5.3 A delivery fee or surcharge is payable for using delivery services, including those provided by third-party providers such as UberConnect
5.4 By using our delivery services, you agree to ensure the safety of the delivery personnel while they are on your premises. You indemnify Bagelstreet, its affiliates, management, and owners against any theft, property loss, damage, injury, or death sustained by delivery personnel on your premises. Additionally, you indemnify Bagelstreet against any loss of your food order while the delivery person is on-site at the address provided during the ordering process.
5.5 We reserve the right to cancel deliveries in cases of adverse weather, traffic disruptions, public unrest, or other extraordinary circumstances affecting driver safety. In such instances, you may be requested to collect your order, and any delivery charges will be refunded.
5.6 While we strive for timely deliveries, factors such as traffic, accidents, road closures, public unrest, and weather conditions may cause delays. We appreciate your understanding and do not offer cancellations or refunds due to delayed deliveries.
5.7 In the event of non-delivery due to an accident or theft by a delivery person appointed by us, we will refund the full amount paid for your order.
PAYMENT
6.1 All orders placed via the Site/App for delivery and/or collection must be for same-day fulfillment and require online payment prior to food preparation.
6.2 Upon receiving your order, we will process it and notify you via the Site/App, SMS, or email regarding its acceptance. Once accepted, you are liable for the full cost of the order.
6.3 Cash payments for delivery are not accepted. Our drivers do not carry card payment machines. Orders must be paid online via a payment link sent by us or through the online Yoco Payment Gateway system.
6.4 No food delivery will be scheduled without prior payment.
6.5 If your payment is unauthorized or rejected by the online Payment Gateway, your order will not be fulfilled.
6.6 All transactions are processed in South African Rands (ZAR). Payments can be made via debit card, credit card, Google Pay, or Instant EFT, depending on availability and eligibility. We utilize secure online payment facilities via Yoco, with all transactions encrypted using appropriate technology.
6.7 Once your order is placed and payment authorized, cancellations or refunds are not permitted.
DRIVER WAITING TIME
7.1 If you are unavailable to accept the delivery and the driver waits more than 6 minutes, you will be charged an additional R8.00 per minute.
7.2 If you cannot accept the delivery, please arrange for an alternative person to do so. If no one is available, your food package may be left with a security guard, receptionist, or another individual at your provided address. Bagelstreet is not responsible for missing food bags due to your unavailability during delivery.
PAYMENTS GENERAL
8.1 The availability of food for delivery and/or collection is at our sole discretion. We may withdraw food or related services if full payment is not received within 15 minutes of placing an order.
ERRORS
9.1 Before submitting your order by clicking "proceed," "place my order," or a similar button, please review and correct any errors. Once submitted, input errors cannot be corrected, and we are not responsible for such errors or omissions.
ORDERING PROCESS
10.1 If you decide not to proceed with your order before clicking "proceed," "place my order," or a similar button, please clear your order basket and close the Site/App window. For orders placed via telephone or WhatsApp, contact us immediately at 068-555-7786 to cancel.
10.2 If food preparation has begun, you are liable for payment of the ordered items.
10.3 Upon receiving your order, we will process it and notify you via the Site/App, SMS, or email regarding its acceptance. Some menu items may be incorrectly priced; if the correct price differs, we will contact you before dispatch.
10.4 If your payment is unauthorized or rejected by the online Payment Gateway, your order will not be fulfilled.
10.5 We do not store credit card data but transmit encrypted information (tokens) to the payment service provider to facilitate payments.
DISCOUNTS AND PROMOTIONS
11.1 Unless specified, promotional offers cannot be combined with other offers and are subject to availability.
11.2 Discounts may apply if you use a promotional code authorized by Bagelstreet. Fraudulent use of promotional codes will invalidate your order.
11.3 Promotions are created for your benefit and typically offer valuable savings. Promotions may be limited; if your cart limit is reached, you cannot add more promotional items. Bagelstreet is not obligated to fulfill amounts exceeding specified promotional limits.
